Impatient for change, Lakewood takes on Colorado’s construction-defects law passing a measure giving developers a “right to repair” and requiring owner associations to get consent from a majority of homeowners before pursuing litigation. The measure is seen as a small step toward promoting multi-family residential construction which has been hampered by high insurance premiums and the substantial risk of litigation under the Colorado Construction Defect Action Reform Act. It is likely the General Assembly will debate similar reforms on the State level during the 2015 session. It is sure to remain a hot topic in the months to come.
